OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES, WHICH INCLUDE A JURY TRIAL AND CLASS ACTION WAIVER. IF YOU DO NOT AGREE TO THESE OFFICIAL RULES, YOU MUST NOT ENTER THE SWEEPSTAKES. THIS SWEEPSTAKES IS NOT SPONSORED, ENDORSED, ADMINISTERED, OR IN ANY WAY ASSOCIATED WITH INSTAGRAM.

1. Eligibility: The Pay the Joi Forward Sweepstakes (“Sweepstakes”) is open only to licensed hair professionals that are (a) legal residents of, and physically located within, the fifty (50) United States and the District of Columbia and (b) 18 years old or the age of majority in their jurisdiction of residence (19+ AL/NE; 21+ MS), whichever is older at the time of entry. All federal, state and local laws and regulations apply. Employees of Henkel Corporation, acting through its Joico division (“Sponsor”) and its affiliates, subsidiaries, advertising and promotional agencies, vendors, contractors, and any company affiliated with the Sweepstakes (collectively, “Sweepstakes Entities”) and the immediate family members (defined as spouse, siblings, children and each of their respective spouses, regardless of residence and any person living in such a person’s household, whether related or not) of each of the foregoing are not eligible to participate. Sponsor reserves the right to verify the eligibility of winners.

2. Entry Period: Sweepstakes begins at 12:00am Pacific Time (“PT”) on March 1, 2025 and ends at 11:59pm PT on March 31, 2025 (“Entry Period”). Sponsor’s computer is the official time keeping device for this Sweepstakes.

3. How To Enter: To enter the Sweepstakes, during the Entry Period visit http://joico.com/pro-giveaways and complete the entry form (“Entry Form”), including name and valid email. Upon submission of the Entry Form, you (“Entrant”) will receive one (1) entry (“Entry”) into the Sweepstakes. Each submission of an Entry Form constitutes a unique Entry into the Sweepstakes. THERE ARE NO LIMITS TO THE NUMBER OF ENTRIES AN ENTRANT MAY SUBMIT.

Normal Internet access, message, data rates, and usage charges imposed by online or phone services may apply. Entries must be submitted by Entrant. Automated or bulk Entries or Entries submitted by third parties will be disqualified. All required information must be provided on the Entry Form. Incomplete, illegible, corrupted, or untimely Entries are void and will be disqualified. Multiple Entrants are not permitted to share the same email address. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address listed on the Entry Form will be determinative. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder or forfeit the prize. If a dispute cannot be resolved to Sponsor’s reasonable satisfaction, the Entry will be deemed ineligible. Sponsor shall not be responsible for lost, misdirected, misplaced, stolen, tampered with, deleted, or invalid Entries or any expenses incurred in the creation and submission of any Entry. Entries specifying an invalid, non-working, or inactive email address will be disqualified.

4. Winner Selection and Notifications: On or about April 2, 2025, twenty-five (25) potential winners (each, a “Potential Winner”) will be chosen in a random drawing from among all eligible Entries received during the Entry Period by Sponsor or Sponsor’s designee. Potential Winners will be contacted via email to the email address provided on the Entry Form (“Notification”). It is a Potential Winner’s responsibility to monitor his/her email address to see if he/she is a Potential Winner. Sponsor is not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify Potential Winners.
The Potential Winner must respond within 72 hours of Notification being sent, and may be required to sign an affidavit or declaration of eligibility, a liability release, and, except where legally prohibited, a publicity release (collectively “Release”) and return the Release along with any other document Sponsor deems necessary to verify eligibility of Entrant or provide prize (collectively, “Documents”) within five (5) business days of receipt thereof. In the event a Potential Winner (a) chooses not to accept the prize, (b) is not in compliance with these Official Rules, (c) is unable to be notified after reasonable attempts, (d) fails to sign and return the Release or other Documents within the required time period (if applicable), (e) is unable to travel on the required dates, (f) is disqualified for any reason, or if any Notification or other correspondence from Sponsor is returned as undeliverable, prize will be forfeited, Sponsor shall have no further obligation to Potential Winner, and an alternate winner will be selected from the remaining eligible Entries. Only one (1) alternate drawing will be held, after which any remaining prize will remain un-awarded.

POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

Upon satisfactory completion of the above, and upon verification of eligibility by Sponsor, a Potential Winner will be deemed a “Sweepstakes Winner”. Once verification is complete, Sweepstakes Winner will then be asked to provide the name and email address of the individual for whom Sweepstakes Winner would like to provide the additional prize (as outlined below) (“Friend”).

5. Prizes/ARV/Odds: Twenty-five (25) prizes (each a “Prize”) are available to be awarded during the Sweepstakes. Each Prize will consist of (a) one thousand dollars ($1,000 USD) for Sweeepstakes Winner and (b) one thousand dollars ($1,000 USD) for Sweeepstakes Winner’s designated Friend, to be provided and delivered as an e-giftcard.

The total approximate retail value (“ARV”) of each Prize is $2,000 USD. The total ARV of all Prizes to be awarded during the Sweepstakes is $50,000 USD.

Limit one (1) prize per person / per household. Odds of winning a Prize depend on the number of eligible Entries received. In the event there is a discrepancy or inconsistency between statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. The Sweepstakes Entities are not responsible for any cancellations, delays, diversions or substitutions, or any act or omission whatsoever with respect to the Prizes. Only the number of Prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more Prizes are claimed than the number set forth in these Official Rules, an alternate winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of Prizes available.
Entrants acknowledge that the Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee express or implied, in fact or in law, relative to Prize, including, but not limited to, its quality or fitness for a particular purpose.
Sweepstakes Winner (and Friend, as applicable) shall be solely responsible for all local, state and federal taxes on his/her Prize including sales or use taxes, as well as any expenses related to participation in the Sweepstakes or acceptance or use of a Prize. The United States Internal Revenue Service (IRS) requires Form 1099-MISC to be issued and filed for each individual who receives a Prize that is $600 or more in actual value. If required, Sponsor will send each Sweepstakes Winner and Friend a W9 form, which must be completed and returned to Sponsor for each to receive their respective Prizes. A copy of the Form 1099-MISC, if filed by Sponsor, will be issued to Sweepstakes Winner and Friend for the fair market value of the Prize received during the applicable calendar year. Any Sweepstakes Winner or Friend who fails to provide information sufficient to complete Form 1099-MISC (including, without limitation, social security number or tax identification number) shall forfeit any and all rights to the applicable Prize.
All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details are subject to change, and Sponsor will provide Entrants with reasonable notice of any change to the prize details. Unclaimed prizes will be forfeited.

6. Prize Restrictions: Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of Prize not specifically stated herein are the sole responsibility of Sweepstakes Winner and/or Friend, as applicable. Prize cannot be substituted, assigned, or transferred; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion. Sponsor will not replace any lost or stolen prizes or components of a Prize. Prize cannot be used in conjunction with any other promotion or offer. If, for whatever reason, Sweepstakes Winner chooses not to provide the name of a Friend, Friend is deemed ineligible to receive the Prize, or Friend declines to accept the Prize, the remaining portion of the Prize shall be forfeited, and Sponsor shall have no further obligation to Sweepstakes Winner (or Friend) for that portion of the Prize.

7. PRIVACY POLICY/DATA COLLECTION: Information collected in connection with this Sweepstakes may be used to execute the Sweepstakes (including travel and Prize fulfillment) and may be used by Sponsor in sending future promotional communications. 8. General: Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of Entry will not be deemed proof of receipt of same by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

9. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for any typographical or other error in the offer or administration of this Sweepstakes, or in the announcement of Sweepstakes Winners and Prizes. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any website used in connection with, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Sweepstakes is not capable of running as planned (including without limitation, fraud, technical failures, or any other factor that is unanticipated or beyond Sponsor’s reasonable control that impairs the integrity or proper functioning of the Sweepstakes) Sponsor may, in its sole discretion, void any suspect Entries and (a) cancel or terminate the Sweepstakes (or any portion thereof); (b) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the Prize(s) at random from among the eligible, non-suspect Entries received up to the time of the impairment.

10. Limitation of Liability; Publicity; Releases: BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT SPONSOR, THE SWEEPSTAKES ENTITIES, INSTAGRAM, AND ITS/THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEBSITE PROVIDERS, WEB MASTERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF THE WEBSITE. EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE SWEEPSTAKES CONSTITUTES SWEEPSTAKES WINNER’S GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR), AND THE SWEEPSTAKES ENTITIES THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLD WIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, AT ANY TIME, THE SWEEPSTAKES WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING BUT NOT LIMITED TO HOMETOWN AND STATE) FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. NOTHING CONTAINED HEREIN SHALL BE DEEMED TO OBLIGATE SPONSOR TO MAKE USE OF ANY OF THE RIGHTS GRANTED HEREIN AND SWEEPSTAKES WINNERS WAIVE ANY RIGHT TO INSPECT OR APPROVE ANY SUCH USE OF ANY AND EVERY NATURE AND KIND.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE WEBSITE AND ALL PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 11. Disputes. All disputes, claims, and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Sweepstakes, the meaning or interpretation of the Official Rules, or any Prize awarded shall be resolved by applying the laws of the state of California, without regard to the conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state. All Claims shall be resolved individually, without resort to any form of class action and all Claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event, include attorneys’ fees, and under no circumstances will any Entrant be permitted to obtain awards for, and, by entering, Entrant waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and waives all rights to have damages multiplied or otherwise increased. 2. Promotion Description: The Promotion will consist of eleven (11) separate and distinct sweepstakes (each, a “Sweepstakes”). Each Sweepstakes will have its own entry period (each, a “Sweepstakes Entry Period”), random drawing (each, a “Drawing”), set of prizes (each, a “Prize”), and potential winners (each, a “Potential Winner”).

3. Sweepstakes Entry Period: Each Sweepstakes Entry Period will begin on the “Entry Start Date” when Sponsor publishes a post on the @joico Instagram account promoting the applicable Sweepstakes (“Social Media Post”) and ends at 11:59pm PT on the “Entry End Date” as listed in the chart below:

Sponsor’s computer is the official time keeping device for this Promotion and each Sweepstakes.

4. How To Enter: The method of entry for each Sweepstakes is the same. Please note that each Sweepstakes must be entered separately. Entry into one Sweepstakes does not constitute entry into any other Sweepstakes.

To enter a Sweepstakes, during the applicable Sweepstakes Entry Period as outlined in Section 3 above you must:
• Follow (if not following already) @joico account on Instagram;
• Like the Social Media Post; and
• In a comment on the Social Media Post, tag the Instagram account of one (1) friend.

Upon completion of the above steps, you (“Entrant”) will receive one (1) entry (“Entry”) into the applicable Sweepstakes. THERE ARE NO LIMITS TO THE NUMBER OF ENTRIES AN ENTRANT MAY SUBMIT PER SWEEPSTAKES.
Each comment that includes a different tagged account/friend constitutes a separate and distinct Entry into the Sweepstakes. However, Entrants may not tag the same account/friend more than once, or that will be considered a duplicate Entry. When there are duplicate Entries, only the first Entry will qualify. All duplicates will be disqualified. Entrants should not tag the Social Media Post. Tagging should occur only in the comment below the Social Media Post.
By entering the Sweepstakes, Entrant agrees that Sponsor may contact Entrant via Instagram Messenger, email, and/or name or tag Entrant on Sponsor’s Instagram page.

Entries specifying an invalid, non-working, or inactive email address or Instagram handle will be disqualified.

Entries, comments and any content submitted or uploaded to any social media site or other public sites in connection with this Promotion or any Sweepstakes (collectively, “Content Submissions”) may not contain, depict or show any content that: (i) is sexually explicit or suggestive, offensive, lewd, profane, obscene; (ii) promotes any activities that may appear unsafe or dangerous, or any political agenda or message; (iii) defames, misrepresents or contains disparaging remarks about Sponsor or other companies; (iv) contains any personal identification, such as license plate numbers, last names (first names are permitted), e-mail addresses or street addresses for any person other than Entrant, or otherwise infringes on the privacy of any person other than Entrant; (v) communicates messages or images inconsistent with the positive image and good will of Sponsor’ brands; and/or (vii) violates any law. Any Content Submissions that contain such content will be disqualified. Sponsor reserves the right in its sole and unfettered discretion to disqualify any Content Submission that it believes is inappropriate, that does not comply with these Official Rules, or that is not consistent with the spirit or theme of the Sweepstakes.

5. Winner Selection and Notifications: There will be fifty (50) Potential Winners selected for each Sweepstakes. Potential Winners will be selected in a Drawing to be held within seven (7) days following the end of the applicable Sweepstakes Entry Period. Sweepstakes Drawings will be conducted by Sponsor or Sponsor’s designee from among all eligible Entries received during the applicable Sweepstakes Entry Period.

Within seven (7) days following the applicable Sweepstakes Drawing, Potential Winners for the Sweepstakes will be contacted via the Instagram account used to enter the Sweepstakes (“Notification”). It is a Potential Winner’s responsibility to monitor his/her Instagram account to see if he/she is a Potential Winner. Sponsor is not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify Potential Winners.

The Potential Winner must respond within 72 hours of Notification being sent, and may be required to sign an affidavit or declaration of eligibility, a liability release, and, except where legally prohibited, a publicity release (collectively “Release”) and return the Release along with any other document Sponsor deems necessary to verify eligibility of Entrant or provide prize (collectively, “Documents”) within five (5) business days of receipt thereof. In the event a Potential Winner (a) chooses not to accept the prize, (b) is not in compliance with these Official Rules, (c) is unable to be notified after reasonable attempts, (d) fails to sign and return the Release or other Documents within the required time period (if applicable), (e) is disqualified for any reason, or (f) if any Notification or other correspondence from Sponsor is returned as undeliverable, prize will be forfeited, Sponsor shall have no further obligation to Potential Winner, and an alternate winner will be selected from the remaining eligible Entries. 6. Prizes/ARV/Odds: The Prizes vary for each Sweepstakes, and each Prize, along with its approximate retail value (“ARV”) is outlined in the chart below:

Any difference between ARV and actual value of Prize will not be awarded. Limit one (1) prize per person / per household. The odds of winning a Prize depend on the number of eligible Entries received during the applicable Sweepstakes Entry Period.

Prizes will be delivered by U.S. Mail or other delivery service, at Sponsor’s or its designee’s sole discretion, to the mailing address provided to Sponsor by Entrant. If a Prize is returned as undeliverable or is unable to be awarded for any reason, the applicable Prize will be forfeited. Sponsor will not replace any lost, stolen, or mutilated Prizes or components thereof. Prizes are non-transferable. No substitutions or cash redemptions will be made, other than as provided herein. Sponsor reserves the right, as determined in its sole discretion, to substitute a prize, in whole or in part, of equal or greater monetary value if a Prize cannot be awarded, in whole or in part, as described for any reason.

In the event there is a discrepancy or inconsistency between statements contained in any such materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. The Promotion Entities are not responsible for any cancellations, delays, diversions or substitutions, or any act or omission whatsoever with respect to the Prizes. Prize Restrictions: Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of Prize not specifically stated herein are the sole responsibility of Sweepstakes Winner. The United States Internal Revenue Service (IRS) requires Form 1099-MISC to be issued and filed for each Sweepstakes Winner who receives a Prize that is $600 or more in actual value. If required, Sponsor will send each Sweepstakes Winner a W9 form, which must be completed and returned to Sponsor for the Sweepstakes Winner to receive his/her Prize. A copy of the Form 1099-MISC, if filed by Sponsor, will be issued to Sweepstakes Winner for the fair market value of the Prize received during the applicable calendar year. Any Sweepstakes Winner who fails to provide information sufficient to complete Form 1099-MISC (including, without limitation, social security number or tax identification number) shall forfeit any and all rights to the applicable Prize.

Prize cannot be substituted, assigned, or transferred; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion. Sponsor will not replace any lost or stolen prizes or components of a Prize. Prize cannot be used in conjunction with any other promotion or offer. If, for whatever reason, Sweepstakes Winner chooses not to provide the name of a Friend, or Friend is deemed ineligible to receive the Prize, the remaining portion of the Prize shall be forfeited, and Sponsor shall have no further obligation to Sweepstakes Winner (or Friend) for that portion of the Prize.

PRIVACY POLICY/DATA COLLECTION: Entrant information collected in connection with this Sweepstakes may be used to execute the Sweepstakes (including travel and Prize fulfillment) and may be used by Sponsor in sending future promotional communications. 3. How To Enter: To enter the Sweepstakes, during the Entry Period visit http://joico.com/pro-giveaways and complete the entry form (“Entry Form”), including name and valid email. Upon submission of the Entry Form, you (“Entrant”) will receive one (1) entry (“Entry”) into the Sweepstakes. Each submission of an Entry Form constitutes a unique Entry into the Sweepstakes. The total approximate retail value (“ARV”) of each Prize is $2,305. The total ARV of all Prizes to be awarded during the Sweepstakes is $23,050. Actual retail value of the Prize may vary, dependent upon Departure Point. Any difference between actual retail value and ARV will not be awarded.

Sweepstakes Winner must be available to travel on dates specified by Sponsor or risk forfeiting Prize. If Sweepstakes Winner resides within a 200 mile-radius of Los Angeles, CA, Sponsor reserves the right to substitute round trip ground transportation to/from Sweepstakes Winner’s residence in lieu of air transportation. Travel subject to availability and blackout dates. Travel arrangements must be made through Sponsor’s agent and on an airline carrier of Sponsor’s choice. Certain travel restrictions may apply. Sweepstakes Winner is responsible for obtaining all necessary travel documents and travel insurance (and all other forms of insurance) at their option, and hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. No refund or compensation will be made in the event of the cancellation or delay of any flight, except at the sole discretion of Sponsor. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Sweepstakes Winner’s transportation, and such contracts shall be solely between the Sweepstakes Winner and such transportation companies. Lost, stolen or damaged airline tickets will not be replaced or exchanged. No stopovers are permitted on tickets issued as part of the Prize. If a stopover occurs, the Prize travel will terminate, and Sweepstakes Winner will be responsible for the full fare, which will be charged from the stopover point for the remaining trip segment(s), including the return. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any air carrier(s) or other transportation companies or any other persons providing any of these services to passengers including any results thereof such as changes in services or accommodations necessitated by same. Airline tickets issued in connection with the prize may not be eligible for frequent flyer miles or upgrades. Sweepstakes Winner must comply with all hotel check-in requirements, including, but not limited to, the presentation of a payment card, which will be used to pay for any meals, phone calls, or incidentals not included in the Prize. Air transportation and hotel accommodations must be taken together and cannot be taken separately.
In the event Sweepstakes Winner engages in behavior during travel or any Sweepstakes-related activity that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the travel or activity early, and send Sweepstakes Winner home with no further obligations or compensation whatsoever (which may, in Sponsor’s sole discretion, result in such Sweepstakes Winner’s disqualification from the Sweepstakes and forfeiture of any (and/or all) Prize(s). In the event Sweepstakes Winner engages in behavior during travel or any Sweepstakes-related activity that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects Sweepstakes Winner to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Sweepstakes Winner as a result of such conduct. How To Enter: To enter the Sweepstakes, visit https://www.joico.com/pro-color/blonde-life/lighteners/#silverlight (the “Website”) during the Term and complete the online entry form by providing your full name, mailing address (no P.O. boxes), email address, and phone number, check the box certifying you are a licensed cosmetologist in the United States, and click submit. All fields on the entry form are required and must be completed to be eligible.

Limit one entry per person, per each Applicable Sweepstakes.

By entering, you agree that Sponsor may contact you via email and/or name you on Sponsor’s social media page. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. Automated or bulk entries or entries submitted by third parties will be disqualified. Entries must be submitted by the participant. Any attempt by any participant to obtain more than the stated number of entries by using multiple and/or different identities or any other methods will void that participant’s entries, and that participant may be disqualified at Sponsor’s discretion. You must complete all required information to be eligible to enter. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. Multiple entrants are not permitted to share the same email address. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder to the Sponsor or forfeit the prize. Entries specifying an invalid, non-working, or inactive email address will be disqualified.

Winner Selection and Notifications: After each Applicable Sweepstakes, the names of three hundred (300) potential Prize winners will randomly be chosen from among all eligible entries received during that Applicable Sweepstakes’ entry period. The three hundred (300) potential Prize winners for Applicable Sweepstakes 1 will be selected on or about October 1, 2024 and the three hundred (300) potential Prize winners for Applicable Sweepstakes 2 will be selected on or about November 4, 2024. Absent any disqualification or ineligibility as determined by Sponsor in its sole discretion and in accordance with these Official Rules, those persons will be deemed the “Sweepstakes Winners”. The Sweepstakes Winners will be contacted via the email, Facebook or Instagram account used to enter the Sweepstakes. Sweepstakes Winners must be able to accept Prize via postal mail. Except where legally prohibited, the Sweepstakes Winners may be required to sign an affidavit of eligibility and a liability and publicity release and return this document within five (5) business days of being notified in order to claim his/her Prize. In the event the Sweepstakes Winners chooses not to accept his/her Prize, is not in compliance with these Official Rules, is unable to be notified, if any correspondence from Sponsor or a Prize is returned as undeliverable, if Sweepstakes Winners fails to sign and return the affidavit of eligibility and liability and publicity release within the required time period (if applicable), or if Sweepstakes Winners are disqualified for any reason, Prize will be forfeited and alternate winners will be selected from all of the remaining qualified entrants. Only five (5) alternate drawings will be held, after which any remaining Prizes may remain un-awarded. Limit one (1) prize per person and per household, per Applicable Sweepstakes. Sweepstakes Winner is solely responsible for all local, state and federal taxes on his/her Prize including sales or use taxes, as well as any expenses related to participation in the Sweepstakes or acceptance of a Prize. The United States Internal Revenue Service (IRS) requires Form 1099-MISC to be issued and filed for each Sweepstakes Winner who receives a Prize if the amount of the prize is $600 or more. If applicable, Sponsor will send each Sweepstakes Winner a W9 form, which must be completed and returned to Sponsor, for the Sweepstakes Winner to receive the Prize. A copy of the Form 1099-MISC filed by Sponsor, will be sent to Sweepstakes Winner. The Form 1099- MISC will be issued for the fair market value of the Prize. Any Sweepstakes Winner who fails to provide information sufficient to complete Form 1099-MISC (including, without limitation, Sweepstakes Winner’s social security number) shall forfeit any and all rights to the applicable Prize. There will be no substitutions or cash redemptions made for any Prize. Sponsor will not replace any Prize or any component of the Prize that is lost, mutilated, or stolen. Odds of winning a Prize depend on the number of eligible entries received. Prizes pictured in advertising, marketing or promotional materials are for illustrative purposes only. In the event there is a discrepancy or inconsistency between statements contained in any such materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. How To Enter: To enter the Sweepstakes, visit https://www.joico.com/pro-color/blonde-life/lighteners/#silverlight (the “Website”) during the Term and complete the online entry form by providing your full name, mailing address (no P.O. boxes), email address, and phone number, check the box certifying you are a licensed cosmetologist in the United States, and click submit. All fields on the entry form are required and must be completed to be eligible.

Limit one entry per person, per each Applicable Sweepstakes.

By entering, you agree that Sponsor may contact you via email and/or name you on Sponsor’s social media page. Normal Internet access, phone, and usage charges imposed by your online or phone service may apply. Automated or bulk entries or entries submitted by third parties will be disqualified. Entries must be submitted by the participant. Any attempt by any participant to obtain more than the stated number of entries by using multiple and/or different identities or any other methods will void that participant’s entries, and that participant may be disqualified at Sponsor’s discretion. You must complete all required information to be eligible to enter. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. Multiple entrants are not permitted to share the same email address. Winner Selection and Notifications: After each Applicable Sweepstakes, the names of three hundred (300) potential Prize winners will randomly be chosen from among all eligible entries received during that Applicable Sweepstakes’ entry period. The three hundred (300) potential Prize winners for Applicable Sweepstakes 1 will be selected on or about October 1, 2024 and the three hundred (300) potential Prize winners for Applicable Sweepstakes 2 will be selected on or about November 4, 2024. Absent any disqualification or ineligibility as determined by Sponsor in its sole discretion and in accordance with these Official Rules, those persons will be deemed the “Sweepstakes Winners”. The United States Internal Revenue Service (IRS) requires Form 1099-MISC to be issued and filed for each Sweepstakes Winner who receives a Prize if the amount of the prize is $600 or more. If applicable, Sponsor will send each Sweepstakes Winner a W9 form, which must be completed and returned to Sponsor, for the Sweepstakes Winner to receive the Prize. A copy of the Form 1099-MISC filed by Sponsor, will be sent to Sweepstakes Winner. The Form 1099- MISC will be issued for the fair market value of the Prize. Any Sweepstakes Winner who fails to provide information sufficient to complete Form 1099-MISC (including, without limitation, Sweepstakes Winner’s social security number) shall forfeit any and all rights to the applicable Prize. There will be no substitutions or cash redemptions made for any Prize. Sponsor will not replace any Prize or any component of the Prize that is lost, mutilated, or stolen. Odds of winning a Prize depend on the number of eligible entries received. Prizes pictured in advertising, marketing or promotional materials are for illustrative purposes only. In the event there is a discrepancy or inconsistency between statements contained in any such materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. The Sweepstakes Entities are not responsible for any cancellations, delays, diversions or substitutions, or any act or omission whatsoever with respect to the Prizes. Prizes are nontransferable. No substitutions or cash redemptions will be made, other than as provided herein. Sponsor reserves the right, as determined in its sole discretion, to substitute a prize, in whole or in part, of equal or greater monetary value if a Prize cannot be awarded, in whole or in part, as described for any reason. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the winner selection method described below from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available.

8. General: Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry, or proof of completion of activity such as visiting Sponsor’s Facebook page, Instagram page or signing up for Sponsor’s newsletter, will not be deemed proof of receipt of entry by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor is not responsible for any typographical or other error in the offer or administration of this Sweepstakes, or in the announcement of Sweepstakes Winners and Prizes. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, the Website, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Sweepstakes is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel or terminate the Sweepstakes (or any portion thereof); (b) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

9. Disputes. All disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Sweepstakes, the meaning or interpretation of the rules or any Prize awarded shall be resolved by applying the laws of California, without regard to the conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state. All Claims shall be resolved individually, without resort to any form of class action and all Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event, include attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and, by entering, entrant waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and waives all rights to have damages multiplied or otherwise increased. ENTRANTS, BY ENTERING, SPECIFICALLY AND KNOWINGLY WAIVE ANY RIGHT TO A TRIAL BY JURY AND A TRIAL BY JURY IS HEREBY WAIVED BY BOTH SPONSOR AND ENTRANTS.
